Terms of Service
1. Eligibility
You must be at least 18 years of age to use the Platform independently. Users between the ages of 13 and 17 may only use the Platform with verifiable parental or legal guardian consent obtained prior to registration. By creating an account, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate and current.
2. The Servvo Platform — Nature of Service
Servvo is a technology platform that enables independent mobile service providers ("Providers") to list services and enables customers ("Customers") to discover and book those services. Servvo is a marketplace only and is not a party to any service agreement between a Customer and a Provider.
Servvo provides Providers with tools to manage their business data, service listings, bookings, and payments in exchange for platform fees as described in Section 8. Servvo does not perform background checks on Providers. Identity verification confirms identity only — it does not constitute an endorsement, certification, or guarantee of any Provider's skills, character, or fitness for any purpose.
3. Account Registration and Security
To access most Platform features, you must register for an account. You agree to provide accurate, complete, and current information and to update such information as necessary. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Servvo reserves the right to suspend or terminate your account at any time, for any reason or no reason, with or without notice.
4. Identity Verification
Servvo requires Providers to submit a government-issued photo identification document and a profile photograph for identity verification. Verification is conducted using Amazon Rekognition, a facial comparison technology provided by Amazon Web Services, Inc. By submitting identification documents and photographs, you explicitly consent to the processing of your biometric data for identity verification purposes. Submission of fraudulent identification is a material breach of these Terms and may be reported to law enforcement.
5. Provider Terms
5.1 Provider Status
Providers are independent contractors, not employees, agents, partners, or joint venturers of Servvo. Providers are solely responsible for the manner and means of performing services, compliance with all applicable laws and regulations, obtaining necessary licenses and permits, and all tax obligations arising from Platform use.
5.2 Service Listings
Providers may list services, set prices, and manage availability through the Platform. Providers represent and warrant that all listings are accurate and not misleading; that they have the skills, experience, and required licenses to perform all listed services; and that services comply with all applicable laws. Servvo reserves the right to remove any listing at any time at its sole discretion.
5.3 Provider Conduct
Providers agree to conduct themselves professionally at all times, honor confirmed bookings except in genuine emergencies, maintain accurate profile information, comply with all Platform policies, and not solicit Customers to complete transactions outside of the Platform for services initiated through the Platform.
5.4 Provider Removal
Servvo reserves the right to remove any Provider from the Platform at any time, for any reason or no reason, at Servvo's sole discretion, with or without prior notice. Removed Providers have no right of appeal, recourse, or compensation for removal. Servvo's decision to remove a Provider is final and binding.
6. Customer Terms
6.1 Booking Services
Customers may browse Provider listings and book services through the Platform. By confirming a booking, you enter into a service agreement directly with the Provider. Servvo is not a party to that agreement.
6.2 Customer Conduct
Customers agree to treat Providers respectfully, provide accurate information about services needed, be available for Provider access at the agreed time and location, pay all agreed fees through the Platform, and not solicit Providers to complete transactions outside of the Platform.
6.3 Independent Assessment
Customers are solely responsible for assessing the suitability of any Provider for their needs. Servvo does not recommend or endorse any specific Provider.
7. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable law.
- Post false, misleading, or fraudulent information on the Platform.
- Circumvent the Platform to arrange services or payments outside of Servvo with users first met through the Platform.
- Harass, threaten, defame, or discriminate against any user.
- Submit fraudulent reviews, ratings, or reports.
- Create multiple accounts to circumvent suspensions, earn duplicate promotional benefits, or manipulate Platform systems.
- Abuse, exploit, or attempt to circumvent any promotional offer, coupon, referral program, founding status, or membership tier through fraudulent means.
- Attempt to transfer, sell, or assign any founding status, tier status, or promotional benefit to another account or individual.
- Reverse engineer, decompile, or attempt to extract source code from the Platform.
- Use automated tools, bots, or scrapers to access the Platform without express written permission.
- Transmit malware, viruses, or harmful code.
- Impersonate any person or entity.
- Violate any intellectual property rights of Servvo or third parties.
8. Fees, Platform Fee Structure, and Payment
8.1 Fee Structure Generally
Servvo operates a split-fee model in which both Providers and Customers contribute to Platform revenue. Providers pay a platform fee on each completed transaction. Customers pay a booking fee on each transaction. Specific rates are determined by each party's volume tier, founding status, subscription plan, and any applicable promotional programs, as published in Servvo's current Rate Schedule at servvo.io/pricing, which is incorporated into these Terms by reference.
8.2 Provider Platform Fee
Providers pay a platform fee calculated as a percentage of the gross transaction value for each completed booking. The effective platform fee is determined by applying the following in order: (1) the Provider's current volume tier rate; (2) any active founding status override rate; (3) any active subscription plan ceiling; and (4) any applicable performance rating reduction. The effective platform fee is always the lowest applicable rate across all factors, subject to a minimum floor as published in the Rate Schedule.
8.3 Provider Volume Tiers
Providers are assigned to volume tiers based on the number of verified completed jobs in the prior calendar month. Volume tiers are recalculated automatically on the first day of each calendar month. Current tier thresholds and associated platform fee rates are published at servvo.io/pricing. Servvo reserves the right to modify tier thresholds and rates with notice as described in Section 14.
New standard Providers receive a grace period during which a reduced platform fee applies regardless of job volume. After the grace period, standard volume tier rates apply.
Providers who maintain continuous activity on the Platform for the period specified in the Provider Benefits Schedule earn a loyalty lock, which protects their earned volume tier during periods of reduced activity. Loyalty-locked Providers whose volume drops below their tier threshold retain their earned tier for the grace period specified in the Provider Benefits Schedule before recalculation occurs.
8.4 Provider Performance Rating Reduction
Providers who achieve and maintain qualifying performance ratings with the minimum verified review counts published in the Rate Schedule may be eligible for additional platform fee reductions that stack on top of their volume tier rate. Rating-based reductions are subject to a minimum platform fee floor as published in the Rate Schedule. Servvo reserves the right to verify ratings and reviews and to withhold or reverse rating-based reductions in cases of suspected manipulation.
8.5 Founding Status Program
Prior to the Platform's public launch, Servvo offers a limited Founding Status Program through which qualifying Providers receive a temporary platform fee override for an initial period following signup ("Founding Window"), as published at servvo.io/founding. During the Founding Window, the Provider's effective platform fee is the lower of: (a) the founding status override rate; or (b) the Provider's current volume tier rate.
- Availability: Founding spots are strictly limited by tier and region. Availability is determined at the time of signup and is not guaranteed.
- Non-transferable: Founding status is tied to the individual Provider account and may not be sold, assigned, gifted, or transferred under any circumstances.
- Termination: Founding status is forfeited immediately upon account suspension or termination for any reason, without recourse or compensation.
- No rate guarantee beyond window: Founding status override rates apply only during the Founding Window. After expiration, the Provider's volume tier rate applies.
- No vesting: Founding status override rates do not vest and do not constitute a contractual right to any specific platform fee rate in perpetuity.
Upon expiration of the Founding Window, Providers who held founding status receive the following permanent benefits: (a) a founding badge displayed on their public Provider profile; (b) a loyalty lock activated immediately upon Founding Window expiration without the standard qualifying period; and (c) priority access to future Platform promotions, fee reductions, new market launches, beta features, and special offers before the general Provider pool, as determined by Servvo at its sole discretion.
8.6 Provider Subscription Plans
Servvo offers optional paid subscription plans for Providers that set a platform fee ceiling and provide enhanced Platform visibility and additional benefits as published at servvo.io/provider-plans. A Provider subscription sets the maximum platform fee the Provider will pay — if the Provider's volume tier rate, founding status override rate, or rating reduction results in a lower effective rate, the lower rate applies.
8.7 Customer Booking Fee
Customers pay a booking fee on each confirmed transaction, calculated as a percentage of the gross job value. The applicable booking fee percentage is determined by the Customer's membership tier, subscription status, and any applicable promotional codes, as published at servvo.io/pricing.
8.7a Payment Authorization and Saved Payment Methods
By confirming a booking, you authorize Servvo, through its payment processor Stripe, Inc., to place an authorization hold on the payment method you provide. An authorization hold reserves funds on your payment method but does not transfer them. Funds are captured only when the booked Provider has marked the work complete and you have approved completion through the Platform. If completion is not approved, holds will be released or otherwise resolved in accordance with Section 8.12 (Refunds and Disputes).
By confirming a booking, you additionally authorize Servvo to store your payment method with Stripe for future use on your Servvo account. Stored payment methods enable faster re-booking and the multi-day booking authorization described in Section 8.7b. Servvo does not store raw card data on its servers, as described in Section 8.11.
8.7b Multi-Day Bookings
Where a single booking covers more than one scheduled service day, Servvo will place a separate authorization hold on your stored payment method for each scheduled service day. You may see multiple pending authorization holds on your card statement, one per service day. Each hold is independent: each is captured only when you approve completion of the work for that specific day, and each is released independently if that day's work is not completed or approved.
By confirming a multi-day booking, you acknowledge and agree that Servvo is authorized to place these per-day authorization holds against your stored payment method on your behalf, without requiring you to re-enter payment details for each.
8.7c Authorization Refresh and Cancellation for Failed Authorization
Where a booked job has not yet been marked complete by the time an existing authorization hold is set to expire, Servvo may, on your behalf, release the existing hold and place a replacement hold in its place against your stored payment method. The replacement hold preserves the original booking authorization for the same job and amount.
You will not be subject to more than one active authorization hold for the same job at the same time. The replacement hold is placed only after the existing hold is released. By confirming a booking, you acknowledge and agree that Servvo is authorized to perform this authorization refresh as needed to keep a valid hold in place until the booking is completed and captured.
If a replacement authorization is declined — including but not limited to declines for insufficient funds, expired card, or authentication requirements that cannot be completed without your in-app participation — Servvo will notify you that your booking requires attention and provide you with the opportunity to re-authorize the booking on a current payment method. If you do not successfully re-authorize the booking within the grace window communicated to you at the time of notification, Servvo may cancel the affected booking. Cancellation under this Section releases all parties from further obligation with respect to that booking. Servvo's decision regarding cancellation under this Section is final.
8.8 Customer Membership Tiers
Customers earn reduced booking fee rates by achieving defined booking count or cumulative spending thresholds as published at servvo.io/pricing. Whichever threshold — booking count or spending — is reached first unlocks the corresponding tier. Tier status is non-transferable and is associated with the individual Customer account.
8.9 Customer Subscription Plans
Servvo offers optional paid subscription plans for Customers that provide instant access to preferred membership tier booking fee rates, periodic promotional credits, and additional benefits as published at servvo.io/member-plans. Upon cancellation, the Customer's tier reverts to the tier earned through verified booking count or spending, whichever is higher.
8.10 Promotional Credits and Coupons
Servvo may issue promotional credits, discount codes, referral rewards, and coupons ("Promotional Benefits") at its sole discretion. All Promotional Benefits are subject to the following conditions:
- Promotional Benefits have no cash value and may not be redeemed for cash under any circumstances.
- Promotional Benefits apply to Platform booking fees only and do not reduce Provider platform fee obligations.
- Promotional Benefits are non-transferable and tied to the individual account to which they are issued.
- Promotional Benefits may not be combined or stacked. Only one Promotional Benefit may be applied per transaction.
- Promotional Benefits expire on the date stated at issuance and will not be reinstated after expiration.
- Referral rewards are issued only upon verified completion of the qualifying action by the referred party, as determined by Servvo in its sole discretion.
- Any attempt to abuse, exploit, or fraudulently obtain Promotional Benefits — including through the creation of multiple accounts, false referrals, or manipulation of Platform systems — constitutes a material breach of these Terms and may result in immediate account termination, forfeiture of all accrued benefits, and legal action.
- Servvo reserves the right to modify, suspend, or terminate any Promotional Benefit program at any time without notice.
8.11 Payment Processing
All payments are processed by Stripe, Inc. By using the Platform, you agree to Stripe's Terms of Service. Servvo does not store raw credit card numbers or sensitive payment data on its servers. Provider disbursements are subject to Stripe's payout schedule and any applicable holds for dispute resolution or fraud review.
8.12 Refunds and Disputes
Servvo is not obligated to issue refunds for completed services. In cases of disputed transactions, Servvo may, at its sole discretion, investigate and issue full or partial refunds, Platform credits, or take no action. Servvo's decision regarding any dispute is final. Servvo reserves the right to withhold or reverse payments in cases of suspected fraud, policy violations, chargebacks, or Terms violations.
8.13 Taxes
Providers are solely responsible for all taxes arising from Platform use, including income taxes, self-employment taxes, and any applicable sales or service taxes. Servvo may issue tax documents as required by applicable law.
9. Off-Platform Transactions
Users who first connect through the Platform are strictly prohibited from arranging services or payments outside of Servvo for a period of twenty-four (24) months following their initial Platform connection. Violation of this prohibition constitutes a material breach of these Terms and may result in immediate account termination, forfeiture of all accrued benefits including any founding status, tier status, and promotional benefits, and Servvo may pursue damages equal to the platform fees and booking fees that would have been earned on the off-Platform transaction.
10. GPS Tracking and Location Data
The Platform uses GPS tracking to provide real-time job status updates during active bookings. By using the Platform, you consent to the collection and display of your location data as described in our Privacy Policy. Providers consent to their real-time location being shared with the Customer during an active job.
11. Ratings and Reviews
Following service completion, Customers and Providers may submit ratings and reviews. By submitting a review, you represent that it is based on genuine first-hand experience and is accurate. Servvo reserves the right to remove any review that violates these Terms or community standards. Reviews that influence platform fee calculations are subject to verification and fraud detection. Attempts to manipulate ratings or reviews to influence platform fee calculations constitute a material breach of these Terms and may result in immediate account termination and forfeiture of all rating-based benefits.
12. Content and Intellectual Property
12.1 Your Content
You retain ownership of content you submit to the Platform. By submitting content, you grant Servvo a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, distribute, and display such content in connection with operating and promoting the Platform.
12.2 Servvo's Intellectual Property
The Platform, including its design, software, trademarks, logos, and content created by Servvo, is the exclusive property of Servvo and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any Servvo content without express written permission.
13. No Background Checks
14. Rate Schedule and Pricing Updates
Specific platform fee rates, booking fee percentages, subscription pricing, tier thresholds, founding program details, and all other numerical values referenced in these Terms are published in Servvo's Rate Schedule at servvo.io/pricing. Servvo reserves the right to update the Rate Schedule subject to the following notice requirements:
- Material rate increases affecting existing users: thirty (30) days advance written notice via email.
- Rate decreases or user-favorable changes: may take effect immediately without prior notice.
- New tier introductions or structural changes: fourteen (14) days advance notice.
- Promotional program modifications: may be modified or terminated at any time without prior notice.
Continued use of the Platform following the effective date of any Rate Schedule update constitutes acceptance of the updated rates.
15. Disclaimer of Warranties
The platform is provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by applicable law, Servvo expressly disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Servvo does not warrant that the platform will be uninterrupted or error-free, or that any provider is qualified, licensed, insured, or suitable for any purpose.
16. Limitation of Liability
To the maximum extent permitted by applicable law, Servvo shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with your use of the platform or any services arranged through the platform.
In no event shall Servvo's total aggregate liability exceed the greater of: (a) the total fees paid by you to Servvo in the twelve (12) months preceding the claim; or (b) one hundred dollars ($100).
17. Indemnification
You agree to defend, indemnify, and hold harmless Servvo, its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Platform; (b) your violation of these Terms; (c) any service you perform or receive through the Platform; (d) your violation of any applicable law or the rights of any third party; (e) any content you submit; or (f) any off-Platform transaction in violation of Section 9.
18. Privacy
Your use of the Platform is governed by our Privacy Policy, incorporated into these Terms by reference. Please review our Privacy Policy at servvo.io/privacy.
19. Third-Party Services
The Platform integrates with third-party services including Stripe for payment processing, Amazon Rekognition for identity verification, Twilio for SMS communications, and Resend for email communications. Your use of these services is subject to their respective terms of service and privacy policies. Servvo is not responsible for the practices of any third-party service.
20. Termination
Servvo may suspend or terminate your access to the Platform at any time, for any reason or no reason, without notice or liability. Upon termination: your right to use the Platform ceases immediately; all founding status, tier status, accrued Promotional Benefits, and subscription benefits are forfeited without recourse; pending disbursements may be held pending fraud review; and Sections 9, 15, 16, 17, and 24 survive termination.
21. Modifications
Servvo reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time. We may update these Terms from time to time. Material changes will be communicated via email or Platform notice. Continued use after the effective date constitutes acceptance.
22. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.
23. Export Controls
You may not use the Platform in violation of U.S. export laws and regulations.
24. Dispute Resolution — Mandatory Arbitration and Class Action Waiver
24.1 Mandatory Arbitration
You and Servvo agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Rate Schedule, any founding status, membership tier, subscription plan, or your use of the Platform shall be resolved exclusively through binding individual arbitration rather than in court. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement.
24.2 Class Action Waiver
You and Servvo each waive the right to a trial by jury and the right to participate in a class action, collective action, or representative action. All disputes must be brought in the parties' individual capacities only. The arbitrator may not consolidate more than one person's claims.
24.3 Arbitration Procedures
Arbitration shall be conducted by a neutral arbitrator in accordance with the American Arbitration Association ("AAA") Consumer Arbitration Rules in Texas. The arbitrator's decision shall be final and binding.
24.4 Exceptions
Either party may seek emergency injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration, including to enforce Section 9 (Off-Platform Transactions).
24.5 Opt-Out
You may opt out of mandatory arbitration by sending written notice to legal@servvo.io within 30 days of first accepting these Terms, including your name and a clear statement that you are opting out.
25. General Provisions
25.1 Entire Agreement
These Terms, the Privacy Policy, and the Rate Schedule constitute the entire agreement between you and Servvo and supersede all prior agreements and understandings.
25.2 Severability
If any provision is found unlawful or unenforceable, it shall be severed and the remaining provisions shall remain in full force.
25.3 Waiver
Servvo's failure to enforce any right or provision shall not constitute a waiver of that right or provision.
25.4 Assignment
You may not assign your rights or obligations under these Terms without Servvo's prior written consent. Servvo may assign these Terms without restriction.
25.5 Force Majeure
Servvo shall not be liable for any failure or delay resulting from causes beyond its reasonable control.
